These Terms of Service ("Terms") govern your use of our website and any purchases you make from us. By using our website or placing an order, you agree to be bound by these Terms.

1. About Us

thebakerV is a small business based in Victoria, Australia, offering freshly baked goods for sale online.

2. Products

thebakerV has made every effort to provide an accurate representation of our products in our online store. However, please note that colors or product appearance may differ from how they may appear on your screen due to the type of device you use to access the store and your device settings and configuration. thebakerV does not warrant that the appearance or quality of any products purchased by you will meet your expectations or be the same as depicted or rendered in our online store.

All descriptions of products are subject to change at any time without notice at our sole discretion. thebakerV reserves the right to discontinue any product at any time and may limit the quantities of any products offered to any person, geographic region or jurisdiction, on a case-by-case basis.

3. Orders & Payments

All orders are subject to availability and when you place an order, you are making an offer to purchase. thebakerV reserves the right to accept or decline your order for any reason at its discretion. Your order is not accepted until thebakerV confirms acceptance. thebakerV must receive and process your payment before your order is accepted.

Please review your order carefully before submitting, as thebakerV may be unable to accommodate cancellation requests depending on the time of cancellation after an order is accepted. In the event that thebakerV does not accept, makes a change to, or cancels an order, thebakerV will attempt to notify you by contacting the e‑mail, billing address, and/or phone number provided at the time the order was made.

Your purchases are subject to return or exchange solely in accordance with section 5 within this policy. You represent and warrant that your purchases are for your own personal or household use and not for commercial resale or export.

thebakerV accepts payment via PayPal, credit cards and all prices are listed in Australian Dollars (AUD) and include GST where applicable.

4. Pricing

Prices, discounts and promotions are subject to change without notice. The price charged for a product or service will be the price in effect at the time the order is placed and will be set out in your order confirmation email. Unless otherwise expressly stated, posted prices do not include taxes, shipping, handling, customs or import charges.

You agree to provide current, complete and accurate purchase, payment and account information for all purchases made. You agree to promptly update your account and other information, including your email address, credit card numbers and expiration dates, so that we can complete your transactions and contact you as needed.

You represent and warrant that (i) the credit card information you provide is true, correct, and complete, (ii) you are duly authorized to use such credit card for the purchase, (iii) charges incurred by you will be honoured by your credit card company, and (iv) you will pay charges incurred by you at the posted prices, including shipping and handling charges and all applicable taxes, if any.

5. Delivery

thebakerV is not liable for shipping and delivery delays. All delivery times are estimates only and are not guaranteed. thebakerV is not responsible for delays caused by shipping carriers, customs processing, or events outside our control. Once we transfer products to the carrier, title and risk of loss passes to you.

We Ship through MailPlus which uses StarTrack, they are able to deliver 95% of their packages within the next business day. This is a guide and delivery times may be shorter or longer than stated.

Delivery is available Australia wide and may incur additional charges.

We do our absolute best to package your order securely — but once it’s with the courier, some things are out of our hands.

If your parcel arrives damaged, please get in touch with us at hello@thebakerv.com as soon as possible. To help us resolve it quickly, please include:

  • Clear photos of the damage

  • Your order number and any specific details

6. Refunds, Returns & Consumer Rights

thebakerV complies with the Australian Consumer Law. This means you are entitled to a replacement or refund if your order is significantly different from what was described, faulty, damaged, spoiled, unsafe for consumption, or has a major fault not caused by misuse .

Please note:

  • Due to the perishable nature of baked goods and as goods are made to order, thebakerV does not offer refunds or returns for change of mind or improper storage once delivered.

  • Due to the nature of our products being perishable and consumable, we’re unable to accept returns or exchanges on any items once they’ve been dispatched. All sales are final.

  • If there is a problem with your order, please contact us within 24 hours at hello@thebakerv.com. thebakerV reserves the right to determine whether the item meets the criteria for refund or replacement.

Nothing in these Terms excludes or restricts your rights under the Australian Consumer Law.

7. Personal Information

thebakerV collects personal information such as your name, address, email, and payment details to fulfill your order.

Your information is handled in accordance with our Privacy Policy, which complies with the Privacy Act 1988 (Cth) and the Australian Privacy Principles (APPs).

8. Intellectual Property

All content on this website, including logos, text, displays, images, graphics, product reviews, video, and audio, and the design, selection, and arrangement of such, is the property of thebakerV and may not be used without permission.

thebakerV name, logos, product, designs, and slogans are used to identify our brand and offerings. You may not use them in a way that suggests affiliation or endorsement without our prior written consent.

9. Feedback

If you submit, upload, post, email, or otherwise transmit any ideas, suggestions, feedback, reviews, proposals, plans, or other content (collectively, “Feedback”), you grant thebakerV a perpetual, worldwide, sublicensable, royalty-free license to use, reproduce, modify, publish, distribute and display such Feedback in any medium for any purpose, including for commercial use. thebakerV may, for example, use our rights under this license to operate, provide, evaluate, enhance, improve and promote the Services and to perform our obligations and exercise our rights under the Terms of Service.

You also represent and warrant that: (i) you own or have all necessary rights to all Feedback; (ii) you have disclosed any compensation or incentives received in connection with your submission of Feedback; and (iii) your Feedback will comply with these Terms. thebakerV is and shall be under no obligation (1) to maintain your Feedback in confidence; (2) to pay compensation for your Feedback; or (3) to respond to your Feedback.

thebakerV may, but have no obligation to, monitor, edit or remove Feedback that is determined in our sole discretion to be unlawful, offensive, threatening, libelous, defamatory, pornographic, obscene or otherwise objectionable or violates any party’s intellectual property or these Terms of Service.

You agree that your Feedback will not violate any right of any third-party, including copyright, trademark, privacy, personality or other personal or proprietary right. You further agree that your Feedback will not contain libelous or otherwise unlawful, abusive or obscene Feedback, or contain any computer virus or other malware that could in any way affect the operation of the Services or any related website. You may not use a false email address, pretend to be someone other than yourself, or otherwise mislead us or third-parties as to the origin of any Feedback. You are solely responsible for any Feedback you make and its accuracy. thebakerV takes no responsibility and assumes no liability for any Feedback posted by you or any third-party.

We reserve the right to refuse service, cancel orders, or terminate access to our website at our sole discretion, especially in cases of misuse or violation of these Terms.

These Terms are governed and construed in accordance with the federal and state or territorial courts in the jurisdiction where thebakerV is headquartered. You and thebakerV consent to venue and personal jurisdiction in such courts.
